From Byron to the Islamic State : exploring the figure of the ‘Foreign Combatant’ in international law (1907 - present)

The figure of the ‘foreign combatant/volunteer’ has been haunting international law for quite some time now. A hybrid actor ranging between the romantic adventurer, the committed idealist, the racist, right-wing mercenary and recently the international terrorist, ‘foreign fighters’ have actually proved extremely difficult to systematize within the formal categories of law. Notably, these categorizations are also the result of highly contextual and deeply politicized assessments of whom is to be considered a ‘good’, or ‘lawful’ foreign fighter. As such, they have worked as to exclude other foreign fighters present in the battlefield, together with delegitimize political adversaries in tense ideological struggles in the context of non-international armed conflicts. By taking a detour in three distinct moments in the recent history of civil war, this thesis aims to show how different ‘figures’ of the foreign combatant have actually informed and keep informing the legal conversations of state representatives, policymakers, international lawyers and national courts in very different times and places. These ‘figures’, it is here contended, linger at the back of the various decisionmakers’ arguments and positions, flooding and shaping their legal imaginaries. They form an ambivalent repertoire which can be revived and used each time to characterize the rightness or the wrongfulness of foreign fighters’ causes, contributing to make of the ‘foreign combatant’ a very ambiguous category whose legacy will not cease to haunt international law.
Cela fait maintenant un certain temps que la figure du « combattant/volontaire étranger » hante le droit international. Acteur hybride allant de l'aventurier romantique à l'idéaliste engagé, au mercenaire raciste de droite, et, récemment, au terroriste international, le « combattant étranger » se montre extrêment difficile à systématiser en utilisant les catégories formelles du droit. Plus précisément, ces catégorisations sont aussi le résultat d'évaluations hautement contextuelles et profondément politisées de qui doit être considéré comme un combattant étranger « bon » ou « légitime ». À ce titre, elles ont œuvré à exclure d'autres combattants étrangers présents sur le champ de bataille, ainsi qu'à délégitimer des adversaires politiques dans ces luttes idéologiques dans le contexte des conflits armés non-internationaux. En faisant un détour par trois moments distincts de l'histoire récente de la guerre civile, cette thèse souhaite montrer comment des « figures » différentes du combattant étranger ont façonné et continuent de façonner les conversations juridiques des représentants des États, des législateurs, des avocats internationaux et des tribunaux nationaux à des moments et à des endroits très différents. Ces « figures » sont présentes en arrière-plan des divers arguments et positions des législateurs, imprégnant et donnant forme à leurs imaginaires juridiques. Elles constituent un répertoire ambivalent qui peut être revivifié et utilisé à chaque fois pour caractériser la nature bonne ou mauvaise des causes des combattants étrangers, contribuant en cela à faire du « combattant étranger » une catégorie très ambivalente dont l'héritage ne cessera de hanter le droit international.
