Faire reconnaître le racisme anti-Asiatiques : la construction d’un problème public par la voie judiciaire

So-called anti-Asian racism has become a public problem in France recognized by the media and by political and judicial institutions in recent years. This article documents one of the forms of mobilization to put this problem on the public agenda : recourse to justice. It offers an analysis of the advantages and limits of this type of collective action, which has multiplied since 2015 to fight against anti-Asian racism. Judicial mobilizations turn out to be a double-edged sword. On the one hand, they contribute to judicial and institutional recognition of violence, to the networking of actors and helps to reduce inter-minority tensions. On the other hand, the judicial arena struggles to take into account the sociological and historical depth that underlies racializing constructions and the relationship of domination in inter-minority tensions.

Le racisme dit anti-Asiatiques est devenu un problème public reconnu par les médias et par les institutions politiques et judiciaires depuis quelques années. Cet article documente une des formes de mobilisations pour mettre ce problème à l’agenda public : le recours à la justice. Il propose une analyse des avantages et des limites de ce type d’action collective qui se multiplie depuis 2015 pour lutter contre le racisme anti-Asiatiques. Les mobilisations judicaires s’avèrent être un outil à double tranchant. D’une part, elles contribuent à une reconnaissance judiciaire et institutionnelle des violences, à la mise en réseau des acteurs et permet de faire reculer les tensions inter-minoritaires. D’autre part, l’arène judiciaire peine à prendre en compte l’épaisseur sociologique et historique qui sous-tend les constructions racialisantes et le rapport de domination dans les tensions inter-minoritaires.
