Regard critique sur les outils méthodologiques du comparatisme. L’exemple des modèles de justice constitutionnelle

Abstract : Legal scholars are used to opposing two « models » of constitutional justice. In the so-called “American model”, constitutional review is decentralized, concrete, operates by way of exception, with an inter partes effect. In the so-called “European model”, constitutional review is centralized, abstract, operates by way of action, with an erga omnes effect. But the analyse of the positive law of various States leads one to deny any scientific interest to such a presentation, for it cannot account for most of the actual legal situations. From a methodological point of view, a refoundation of legal comparison compels one to resort to the tools offered by legal theory. Only such an approach can allow to build a neutral metalanguage, able to offer an exhaustive and precise model of intelligibility of constitutional justice, taking into account its geographical and historical diversity.
