Innovation et brevet : une comparaison transatlantique

Abstract : Innovation and Patent : A Transatlantic Comparison Given the level of public and private Research and Development (R&D) expenditure, Europe and France in particular have registered huge delays in their innovative production since the beginning of the 1990’s, compared with the United States. The most significant difference is provided by the American system of Industrial Property Rights (IPR), who strongly encourages innovation under both an efficient policy of patents and control. This article aims at providing some comparative elements of the economic and juridical characteristics of IPR systems, as well as underlining possible improvements for the implementation of a community patent.
