L'internationalisation du capitalisme d'État en question : Les failles de l'encadrement juridique des risques politiques et économiques posés par les investissements souverains étrangers (entreprises d'État et fonds souverains)

Abstract : Long mainly confined to the sole domestic market, State capitalism has henceforth distinguished itself by its international outreach, particularly through State-owned enterprises and sovereign wealth funds multiplying overseas acquisitions. Those transactions, when involving sensitive sectors, can be unfavorably perceived by host States afraid of the appropriation of strategic assets by foreign powers. The economic conditions of sovereign investments have also raised concerns since those actors may benefit from subsidies that are likely to distort competition within the framework of such acquisitions. These political and economic risks are, however, insufficiently taken into consideration in international economic law.
