L’égalité entre les sexes dans le droit : de la discrimination justifiée à la discrimination positive : Analyse de la jurisprudence française et communautaire

Abstract : As a space for transforming the social fact in law, case law opens up a dynamic vision of equal rights which transcends the formal equality that is synonymous with indifference to differences, in order to promote corrective or resultbased equality, by implementing planned voluntary actions to prevent discrimination or make up for past discrimination. This development will be examined based on the meanings given to the principle of equality between male and female workers in Community and French case law. Since employment pertains to the field of jurisdiction of European Communities, which became the European Union in 1992, the development of French legal standards related to gender equality should be considered in light of the harmonization of French and European case law.
